By Sant Kumar Sharma , It is an interesting and engrossing debate going on about the future of Article 35 A. In J&K and at many other places all over India.
It is overheated and devoid of much substance at many places. The efforts are to create support for one’s viewpoint. Be it by those who are demanding it’s scrapping or those who are opposed to its scrapping.
There is hardly any substantial questions of law that are being put forward by either side. Invoking emotional responses is the strategy.
Let me say what I understand about how things are going to pan out. The cases pertaining to this article are pending in the Supreme Court. So, they are most likely to be decided by the apex court.
The Central government has a majority in the Lok Sabha. It lacks a simple majority in the Rajya Sabha.
It needs to be pointed out here that usually for fiddling with anything like this article, which will need a constitutional amendment, two-thirds majority is mostly needed. No question of such a majority is there with the BJP and it’s allies as of now.
As such, the issue will continue to cause polarisation and debate among the masses. With no substantial progress on the political front.
It is only the Supreme Court which will be able to decide it’s fate, it appears. That too not in a hurry.
